You are an obligated producer if your business has an annual turnover of £1 million or more AND handles 25 or more tonnes of packaging per year. Both thresholds must be met. Obligated activities include supplying packaged goods under your own brand, placing goods into packaging, importing products in packaging, owning an online marketplace, and hiring or loaning reusable packaging. Charities are exempt from EPR obligations regardless of their turnover or packaging volumes.

Small producers have a turnover between £1 million and £2 million AND handle more than 25 tonnes of packaging, OR have a turnover above £1 million AND handle between 25 and 50 tonnes. They report annually, with full-year data due by 1 April. Large producers have a turnover of £2 million or more AND handle more than 50 tonnes of packaging. They report every 6 months — H1 data (Jan-Jun) due by 1 October, H2 data (Jul-Dec) due by 1 April.

The Environment Agency has enforcement powers including warning letters for minor breaches, compliance notices requiring corrective action, civil penalties for repeated non-compliance, variable monetary penalties for significant offences, and criminal prosecution in the most severe cases (which can result in unlimited fines). Enforcement actions are published, which can also cause reputational damage.

You submit your packaging data directly to DEFRA via the Report Packaging Data (RPD) portal. The scheme is administered by PackUK, who collects data and fees from obligated producers.
