Non-Obligated Producer

A business that falls below the EPR tonnage or turnover thresholds and is therefore not legally required to register, report, or pay packaging waste fees under the current regulations.

A non-obligated producer is a business that does not meet the minimum thresholds to be classified as an obligated producer. This means either their annual packaging handling is below 25 tonnes, their turnover is below £1 million, or both.

However, even non-obligated businesses should consider voluntary compliance as the thresholds may change. They may also still be subject to other regulations such as the Plastic Packaging Tax (which has its own separate threshold of 10 tonnes). Non-obligated producers should still follow waste hierarchy principles and may benefit from reducing packaging to save costs.
